Fair Use Notice

Unless otherwise stated, all content and photos on this site are copyright Fred Harding. However, you may wish to use some material under the terms of Fair Use, and this is granted. Likewise, this site may contain quoted copyrighted material the use of which has not always been specifically authorized by the copyright owner. This material is made available in order to advance understanding of issues of environmental, political, human rights, economic, democracy, historical, scientific, and social justice significance. Under these circumstance, it is believed that such material used constitutes a 'fair use' under U.S.A and UK law. What is "Fair Use" (also known as fair dealing)?

Generally speaking the fair use of a copyrighted work for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. For example, in the U.S.A, the 1961 Report of the Register of Copyrights on the General Revision of the U.S. Copyright Law cites examples of activities that courts have regarded as fair use: "quotation of excerpts in a review or criticism for purposes of illustration or comment; quotation of short passages in a scholarly or technical work, for illustration or clarification of the author's observations; use in a parody of some of the content of the work parodied; summary of an address or article, with brief quotations, in a news report; reproduction by a library of a portion of a work to replace part of a damaged copy; reproduction by a teacher or student of a small part of a work to illustrate a lesson; reproduction of a work in legislative or judicial proceedings or reports; incidental and fortuitous reproduction, in a newsreel or broadcast, of a work located in the scene of an event being reported." Basic guidelines include:

Non-commercial research and private study

It is allowed to make single copies or take short extracts of works when used for research that you do not make any money from or from private studying, educational course or even as a hobby. Limited use or fair dealing is only permitted for non-commercial research and private study when using literary (written work), dramatic (theatre), music, artistic work (art, photographs, and so on) or the layout of a publication (the font size, font style, and so on). The purpose of this exception is to provide students and non-commercial researchers more access to copyright works. In assessing whether your use of the work is permitted or not you must assess if there is any financial impact on the copyright owner because of your use; where impact is not significant, the use may be acceptable. Therefore, it is fair dealing.

Criticism or review, reporting current events

Fair dealing for criticising or review and reporting current events is allowed for any type of copyright work (except a photograph) as long as it is with a sufficient acknowledgment. A photograph cannot be reproduced for the purpose of reporting current events. The intention of the law is to prevent newspapers or magazines reproducing photographs for reporting current events which have appeared in competitor’s publications.

Publicly situated works

Drawing, taking a photograph or making a film of buildings or sculptures and works of artistic craftsmanship in a public place or in premises open to the public.

Nudity and Semi-Nudity on this Website

Some areas of this site contains the unclad bodies or semi-naked men and women of a non-pornographic nature. Pornography sometimes shortened to porn or porno, is the explicit representation of the human body with the goal of sexual arousal. The pictures on this site do not fit into this category but are used instead for education or illustrative purposes. So you will find pictures of nude sculptures, famous paintings and full nude male and female models, including myself, in non-pornograhic poses. Such pictures are not intended to offend and so in articles that do not specifically discuss nudity, but where nude male photos are shown, a figleaf has been overlayed on the picture of the male genital region when necesssary. Although in some countries of the world bare female breasts are considered the same as actually being naked, this site does not agree with this view and so female breasts are displayed without censorship.

As far as nudity is concerned clearly the 1.2 million people who visit Florence to see Michelangelo's greatest work "David" each year are not offended by the beautiful form of the 19 foot naked man in all his glory. Michelangelo himself said, "What spirit is so empty and blind, that it cannot recognize the fact that the foot is more noble than the shoe, and skin more beautiful than the garment with which it is clothed? ". So with this in mind, the nude pictures on this site reflect the beauty that Michelangelo endeavoured to emulate through his famous statue. Remember Michelanglo's sculpture "David" is only an imitation of the real thing. If you have a problem with that, then I suggest you see a Gymnophobic consultant....

Gymnophobia is usually described in medical dictionaries as an "abnormal and persistent fear of nudity". It is said that those who suffer from this mental illness, and that is most people, worry about seeing others naked or being seen naked, or both. In some cases, this fear is so extreme that special medical centres have been established to help those so affected to overcome their affliction The Gymnophobia Clinic at The CTRN Phobia Clinic, for example works with Gymnophobia clients around the world to help them overcome this phobia. The problem with using such a clinic is that you have to pay for the treatment, when in fact, if you continue exploring this site you will not need to, but will hopefully realise that the naked human body if maintained well is a beautiful thing and should not be feared or should cause offense.
